1. DEFINITIONS

1.1. Seller – UAB Papricado, legal entity code 306745648, address Polocko g. 56-72, LT-01205 Vilnius, VAT payer code 100016985410.

1.2. Online Store – this online store, located at https://papricado.eu/.

1.3. You / Buyer – a natural person capable of concluding transactions according to applicable laws, who purchases goods for personal use (not for business purposes).

1.4. Rules – these rules, which establish the procedures for returning and exchanging goods purchased in the Online Store.

1.5. Parties / Party – Buyer and Seller together or separately.

1.6. Goods / Services – all items traded in the Online Store. Further in the Rules, ‘goods’ include services when both goods and services are sold in the Online Store, unless otherwise specified in the Rules.

2. GENERAL PROVISIONS

2.1. These Rules establish the mutual rights, obligations, and responsibilities of the Buyer and the Seller regarding the return and exchange of goods purchased in the Online Store.

2.2. These rules are part of the general rules for purchasing goods in the Online Store, which you can review here: https://papricado.eu/en/terms-of-service.

3. RETURNING AND EXCHANGING GOODS

3.1. The Buyer has the right to withdraw from the purchase agreement within 14 (fourteen) days from the day of delivery (receipt) of the goods without providing a reason, except for contracts specified in Article 6.228, Part 2 of the Civil Code of the Republic of Lithuania.

3.2. To return a quality item(s), the Buyer must notify the Seller in writing (by email) by submitting a free-form return letter. The Buyer must return the item no later than 14 (fourteen) days from the day of delivery (receipt) of the item.

3.3. When returning quality goods, the Buyer is responsible for the proper packaging of the item for return. The Buyer bears the direct costs of returning the item unless the Seller specifies otherwise after receiving the notice of withdrawal. If the Buyer returns defective goods, the return costs are covered by the Seller.

3.4. Goods can be returned via Venipak, LP EXPRESS or OMNIVA parcel lockers. To return goods by other methods, conditions are arranged individually with the Seller.

3.5. The Buyer will be refunded for the returned item, including any amounts paid by the Buyer for delivery (if returning a defective item), after the goods are returned to the Seller.

3.6. Refunds are made using the same payment method that the Customer used for the transaction.

3.7. The Seller is not considered to have violated the refund conditions if they are unable to transfer the money due to the Buyer’s fault (delay in returning the goods, incorrect data, etc.).

3.8. When returning goods, the Buyer must adhere to the following conditions:

3.8.1. the returned item must be in its original packaging;

3.8.2. the returned item must not be damaged by the Buyer;

3.8.3. the returned item must be unused, retaining its commercial appearance (labels, protective films intact; this point does not apply if returning a defective item);

3.8.4. the returned item must be in the same set as received by the Buyer;

3.8.5. the purchase invoice and the completed return request must be provided when returning the item.

3.8.6. if the returned goods were purchased at a discounted price, the amount refunded will be the amount for which they were purchased.

3.9. If the returned item is incomplete, damaged, untidy, and/or improperly packaged, the Seller has the right not to accept the returned item and not to refund the Buyer the amount paid for the returned item.

3.10. In the case of the sale of defective goods, the Buyer may request to replace the defective item with a suitable one, reduce the price of the item, return the item, and receive a refund. The exchange and return of defective goods are carried out according to these Rules and the laws of the Republic of Lithuania.

3.11. The Buyer cannot return goods for which the possibility of return is not provided by the laws of the Republic of Lithuania.

4. FINAL PROVISIONS

4.1. These Rules are regulated by the applicable laws of the Republic of Lithuania and the European Union.

4.2. The Seller has the right to unilaterally, without additional notice, change the Rules at their discretion. Changes come into force from the moment they are posted in the Online Store and are binding on the Buyer who wishes to use the Online Store.

4.3. The Seller may transfer their rights and obligations arising from these Rules to third parties at any time without the Buyer’s consent and without notifying them.

4.4. Any disputes between the Buyer and the Seller shall be resolved through negotiations. If the parties cannot reach an agreement, disputes are finally resolved in accordance with the laws of the Republic of Lithuania.

4.5. The Buyer-consumer may submit a request and/or complaint regarding the goods or services purchased in the Store to the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, tel. 8 5 262 67 51, fax. 8 5 279 1466, email [email protected], website www.vvtat.lt, to its territorial divisions in the counties) or fill out the application form on the Electronic Consumer Dispute Resolution Platform, available at http://ec.europa.eu/odr/. This condition does not apply to Buyers who are entrepreneurs.
